Charter schools must develop and publish a lottery policy and process on their website when applications exceed capacity for a program, class, grade level, or building.

Charter schools must give enrollment preference to siblings of enrolled pupils and foster children of enrolled pupils' parents, and may give preference to school staff children before conducting lottery admissions.

Charter schools in Duluth township (St. Louis County) or the city of Nerstrand (Rice County) serving kindergarten through grade 6 must prioritize students living within a five-mile radius and siblings of enrolled children.

Charter schools may not limit admission based on intellectual ability, achievement or aptitude measures, or athletic ability, and cannot distribute goods or services as inducements to enrollment.

Charter schools with at least 90 percent deaf or hard-of-hearing students may enroll prekindergarten pupils with disabilities and must comply with federal Individuals with Disabilities Education Act requirements.
