HF 2932 Summary

• Adds negligent driving while operating a cellular phone or other electronic device without hands-free setting as a new criminal offense to four existing vehicular homicide and operation statutes (sections 609.2112, 609.2113, and 609.2114).

• Creates clause (9) penalties for negligent operation of a motor vehicle while using electronic devices across all four offense categories: criminal vehicular homicide (up to 10 years imprisonment/$20,000 fine), great bodily harm (up to 5 years/$10,000 fine), substantial bodily harm (up to 3 years/$10,000 fine), bodily harm (up to 1 year/$3,000 fine), and injury to unborn child (up to 5 years/$10,000 fine).

• Increases maximum prison sentences to 15 years for violations of clauses (2) through (6) that occur within ten years of a qualified prior driving offense.

• Applies the provisions to crimes committed on or after August 1, 2018.
