School boards may renew expiring referendums by board action instead of holding an election, provided the per-pupil amount remains the same as the expiring referendum and the new term does not exceed the initial term approved by voters.

School board must adopt a written resolution authorizing renewal after holding a public meeting and allowing public testimony on the proposed renewal.

Resolution must be adopted by June 15 of any calendar year and becomes effective 60 days after adoption.

School board may renew an expiring referendum no more than two fiscal years before the referendum expires, where expiration occurs in the last fiscal year the referendum generates revenue.

Districts renewing a referendum must submit a copy of the adopted resolution to the state commissioner and county auditor no later than September 1 of the calendar year in which the levy is certified.
