HF2987 Summary: Prescription Drug Repository Program

• Establishes a statewide prescription drug repository program administered by the Board of Pharmacy through a contracted central repository (wholesale distributor) by January 1, 2019, allowing donation of unused prescription drugs and supplies.

• Eligible donors include health care facilities, skilled nursing facilities, assisted living facilities, pharmacies, wholesalers, and manufacturers; eligible recipients must be Minnesota residents who are uninsured or lack prescription drug coverage.

• Drugs must be in original sealed unopened packaging with at least 6 months until expiration, cannot be controlled substances, and must pass inspection by a pharmacist or practitioner before dispensing.

• Repositories may charge handling fees up to 250 percent of the medical assistance program dispensing fee and cannot receive reimbursement from medical assistance or MinnesotaCare for dispensed drugs.

• Provides liability immunity to manufacturers, health care facilities, pharmacists, practitioners, and donors for acts or omissions occurring during proper program participation, except for reckless, wanton, or intentional misconduct.
