H.F. 3045 Summary

• Amends Minnesota Statutes section 609.06 to add a new subdivision (3) prohibiting use of force against another person based on discovery, knowledge, or disclosure of the victim's actual or perceived sexual orientation, gender identity, or expression, even if the victim made an unwanted nonforcible romantic or sexual advance or had a prior dating relationship with the actor.

• Amends section 609.075 to establish that a defendant's discovery of, knowledge about, or potential disclosure of the victim's sexual orientation or gender identity is not a defense to any crime, including when the victim made an unwanted nonforcible romantic or sexual advance.

• Amends section 609.20 (manslaughter in the first degree) to specify that discovery of, knowledge about, or potential disclosure of the victim's sexual orientation or gender identity does not constitute legal provocation that would reduce a killing to manslaughter.

• All amendments become effective August 1, 2018, and apply to crimes committed on or after that date.
