HF 3150 Summary

• Road authorities must cut down, eradicate, or destroy noxious weeds on highways, streets, and ditches as necessary to prevent seed ripening and scattering, with violations subject to a fine deposited in the trunk highway fund.

• Outside cities, road authorities may not mow or till highway rights-of-way except: the first eight feet from the road surface at any time, the entire right-of-way after July 31, and for safety or sight distance maintenance from August 31 to July 31 at a minimum height of 12 inches.

• Landowners or authorized occupants of abutting or adjacent property may mow or hay rights-of-way without permits or temporal restrictions, with a hierarchy of authority giving priority to abutting landowners, then adjacent landowners, then road authorities.

• Road authorities must provide reasonable assistance for mowing or haying upon request and must remove bales or obstructions within ten days of creation.

• Amended statute 160.2715 to authorize landowner mowing activities under sections 160.23, 160.232, and 160.233, with violations remaining misdemeanors.
