School boards may renew expiring capital project levy referendums by board action without holding a public election, provided the local tax rate remains the same and the renewed term does not exceed the initial voter-approved term.

School boards may renew expiring referendums under section 126C.17 by board action if the per-pupil amount stays the same and the term does not exceed the initial voter-approved term.

Renewal requires a written resolution adopted by the school board by June 15 of any calendar year after holding a public meeting and allowing public testimony, with the resolution becoming effective 60 days after adoption.

School boards may only renew referendums not more than two fiscal years before expiration, and must submit the adopted resolution to the commissioner and county auditor by September 1 of the year the levy is certified.

Both renewal provisions take effect July 1, 2018.
