Defines "secondary school" as a public or nonpublic school, church or religious organization, or home school where students may legally fulfill compulsory instruction requirements.

Defines "independent contractor" as any person who contracts with or volunteers for a secondary school or any person employed by a business that contracts with a secondary school.

Establishes criminal sexual conduct in the third degree for employees or independent contractors of secondary schools who engage in sexual penetration with students aged 16-20 who have not graduated, with no mistake of age or consent as a defense.

Establishes criminal sexual conduct in the fourth degree for employees or independent contractors of secondary schools who engage in sexual contact with students aged 16-20 who have not graduated, with no mistake of age or consent as a defense.

Effective August 1, 2018, and applies to crimes committed on or after that date.
