• Adds new criminal penalties for peace officers (full-time or part-time) who engage in sexual penetration or sexual contact with individuals they are physically or constructively restraining, or who do not reasonably feel free to leave the officer's presence.

• Sexual penetration by a peace officer under these circumstances constitutes criminal sexual conduct in the third degree; consent by the complainant is not a defense.

• Sexual contact by a peace officer under these circumstances constitutes criminal sexual conduct in the fourth degree; consent by the complainant is not a defense.

• Exempts lawful searches involving penetration of the mouth, genitals, or anus from these criminal penalties.

• Amends Minnesota Statutes sections 609.344, subdivision 1 (third degree sexual conduct) and 609.345, subdivision 1 (fourth degree sexual conduct).
