Local government units must limit application fees for new or replacement wireless facilities to actual costs incurred, including third-party consultant costs, with a maximum cap of $3,000.

The fee limitation applies to wireless facilities installed on structures specifically designed to support wireless facilities, water towers, buildings, or other structures designed primarily for other purposes.

"Wireless facility" is defined as equipment at a fixed location enabling wireless services between user equipment and a wireless service network, including adjacent equipment storage facilities, but excludes small wireless facilities as defined in section 237.162.

The law becomes effective the day after final enactment and applies to all applications filed on or after that date.

The bill amends Minnesota Statutes 2016, section 462.353, by adding a new subdivision and proposes new coding in chapter 394.
