The Pollution Control Agency must not enforce air quality permit conditions that limit either the number of vehicles delivering grain or the amount of grain delivered to an ethanol production facility during any period of time.

The agency must analyze and consider cumulative environmental pollution levels and effects from all sources when issuing permits to facilities located in first-class cities in Hennepin County that meet five specific conditions, including proximity to EPA superfund sites, low-income populations of color, high rates of childhood health problems, air quality alert days, and proximity to heavily trafficked highways.

The agency retains authority to revoke or modify permits when necessary to prevent or abate pollution.

County ordinances and land use controls remain enforceable and are not superseded by agency permit issuance.
