Cities, towns, and counties must provide management and supervision of maintenance and care for abandoned cemeteries located within their jurisdiction.

Cities, towns, and counties must accept transfer of an abandoned cemetery when the cemetery association adopts a resolution to transfer it, as provided under Minnesota Statutes section 306.025.

These mandatory transfer and management requirements apply only to abandoned cemeteries where a veteran is known or can be proven to be interred.

All cities, towns, and counties with abandoned cemeteries must file a report with the state auditor by November 30, 2018, outlining a plan to maintain and manage each cemetery, including whether it will be transferred, moved, or closed.

The state auditor shall compile all submitted reports and make them available to the public.

The bill becomes effective August 1, 2018.
