HF4224 - Older and Vulnerable Adults Rights and Protection Act of 2018

• Expands patient and resident rights in health care facilities, nursing homes, and assisted living establishments, including right to place cameras in private spaces and prohibition on facility retaliation for asserting rights or reporting maltreatment.

• Establishes private right of action allowing patients, residents, or interested persons to sue facilities for violations of health care bill of rights and recover damages of at least $5,000 plus attorney fees.

• Strengthens vulnerable adult maltreatment reporting requirements, modifies investigation procedures, establishes rebuttable presumption of retaliation within 90 days of reporting, and creates Assisted Living Licensing Task Force to review regulation gaps.

• Requires housing with services establishments to designate at least 10% of beds for medical assistance elderly waiver residents and prohibits relocation of private pay residents to shared rooms without consent.

• Appropriates funding for electronic case management system, data analyst position, and website upgrades for Office of Health Facility Complaints; repeals previous vulnerable adult maltreatment review panel statute.
