HF 4422 Summary

• Establishes that the city of Duluth holds title in fee simple absolute to property described in a condemnation certificate recorded on August 11, 1915, in St. Louis County records (Book 394 of Deeds, p. 418, and Document No. 19347), including all riparian rights.

• Overrides the Minnesota Supreme Court decision in Smith v. City of Minneapolis (1910) regarding property ownership in Duluth.

• Exempts Duluth's ownership and title to the specified property from Minnesota Statutes section 541.023, notwithstanding any other applicable law.

• Takes effect the day after the city of Duluth's governing body and chief clerical officer complete compliance with Minnesota Statutes section 645.021, subdivisions 2 and 3.
