Establishes crime of unauthorized computer access that includes attempting to or penetrating an electronic terminal, defined as point-of-sale terminals, automated teller machines, cash dispensing machines, and gas pump dispensers.

Creates felony offense for accessing or attempting to access an electronic terminal by opening panels or doors without authorization and placing or attaching electronic devices to capture, store, or communicate access device information, with up to 10 years imprisonment or $20,000 fine.

Establishes gross misdemeanor offense for accessing or attempting to access an electronic terminal through opening panels or doors without authorization, with up to one year imprisonment or $3,000 fine.

Creates enhanced penalties for violations that create grave risk of death, compromise protected data security, result in access to personal data, or constitute second or subsequent misdemeanor violations within five years.

Effective date is August 1, 2018, and applies to crimes committed on or after that date.
