HF 84 Summary

• School buses purchased after December 31, 2017, must be equipped with approved lap and shoulder belts for each passenger seating position.

• The commissioner shall establish standards for design and installation of lap and shoulder belts that are exempt from Minnesota's rulemaking requirements under chapter 14.

• Passengers must use lap belts or lap and shoulder belts unless the passenger or parent/guardian notifies the school district in writing of intent not to wear them.

• School districts and bus operators are not liable solely because an injured party was not wearing a safety belt, but remain liable for failure to maintain equipment or comply with applicable laws and policies.

• School districts and bus operators are not liable for failing to assist children with adjustment, fastening, or other use of lap belts or shoulder belts.
