Commissioner of Education must establish a process to approve education programs operated by care and treatment facilities, mental health day treatment programs, charter schools, or other educational institutions at specified facilities.

Approved education programs must conform to state and federal education laws, including the Individuals with Disabilities Education Act (IDEA).

Application process must include an appeal procedure with a hearing before an administrative law judge under section 14.50.

If an education program is approved at a facility, that facility or educational institution becomes the providing district or providing agency for education services, including special education if eligible.

If no education program is approved at a facility, the district where the facility is located must provide education services, including special education if eligible, to all students placed there.

Effective date is August 1, 2017.
