Municipalities may enter into multiyear professional service contracts for water storage tank engineering, repair, and maintenance through direct negotiation or request for proposals if three conditions are met.

Contracts must require that annual municipality payments not exceed water utility charges received that year, work be performed under review of a licensed Minnesota professional engineer, and costs for bringing tanks into compliance with federal, state, or local requirements be itemized separately and spread over at least three years.

Contracts estimated to exceed $100,000 must use standard municipal procurement methods specified in subdivision 3 or 3a rather than the direct negotiation or request for proposals exception.

Effective September 1, 2017, and applies to contracts entered into on or after that date.
