School boards may renew expiring referendums by board action without holding a public election if three conditions are met: the per-pupil amount remains the same, the renewal term does not exceed the original voter-approved term, and the board adopts a written resolution after holding a public meeting with testimony.

School boards must adopt the renewal resolution by June 15 of any calendar year, and the resolution becomes effective 60 days after adoption.

School boards may only renew an expiring referendum no more than two fiscal years before it expires, defined as the last fiscal year the referendum generates revenue for the district.

Districts must submit a copy of the adopted resolution to the state education commissioner and county auditor no later than September 1 of the calendar year in which the levy is certified.

The law is effective July 1, 2018.
