SF2582 Summary

• Establishes new crimes for intentionally and without authorization attempting to or penetrating electronic terminals, including point-of-sale terminals, gas pump dispensers, and automated teller machines.

• Creates a felony offense for accessing electronic terminals by opening panels or access doors without authorization and placing or attaching electronic devices to capture, store, or communicate access device information.

• Creates a gross misdemeanor offense for accessing or attempting to access electronic terminals by opening or attempting to open any panel or access door without authorization.

• Defines "electronic terminal" as an electronic device through which individuals or companies may initiate electronic fund transfers, and "access device" as cards used to initiate transactions or access accounts and government benefits.

• All provisions effective August 1, 2018, and apply only to crimes committed on or after that date.
