School boards may renew expiring capital project levy referendums by board action instead of holding an election if the local tax rate remains the same as the expiring referendum and the renewed term does not exceed the initial voter-approved term.

School boards may renew expiring referendums under section 126C.17 by board action if the per-pupil amount remains the same as the expiring referendum and the renewed term does not exceed the initial voter-approved term.

School boards must adopt a written resolution authorizing renewal after holding a public meeting and allowing public testimony, with adoption required by June 15 of any calendar year and effectiveness 60 days after adoption.

School boards may renew referendums no more than two fiscal years before they expire, and must submit the adopted resolution to the commissioner and county auditor by September 1 of the certification year.

Both provisions are effective July 1, 2018, and school boards using this authority must comply with section 123B.71 requirements and obtain positive commissioner review if required before funding projects.
