Prohibits counties, statutory or home rule charter cities, and towns from adopting or enforcing ordinances that regulate, prohibit, restrict, or impose fees on auxiliary containers.

Defines auxiliary containers as bags, cups, bottles, or other packaging made from cloth, paper, plastic, cardboard, aluminum, glass, or similar materials designed for consuming, transporting, or protecting merchandise, food, or beverages at food service or retail facilities.

Exempts auxiliary containers sold, leased, or provided at facilities owned or operated by cities or towns from the prohibition.

Makes the section effective the day following final enactment with retroactive application, voiding any ordinances adopted prior to enactment that violate this provision.
