SF3438 Summary

• Establishes electronic monitoring rights in health care facilities (nursing homes, boarding care homes, housing with services establishments) with consent requirements, facility accommodation obligations, and visitor notification requirements effective January 1, 2019.

• Modifies health care bill of rights and home care bill of rights to prohibit deceptive marketing and business practices, require 30-day termination notice, and protect resident rights to electronic monitoring and Internet service.

• Strengthens vulnerable adult maltreatment protections by requiring 24-hour reporting to common entry points, establishing lead investigative agency notification and investigation timelines, and creating retaliation prohibitions with civil and criminal penalties.

• Creates Crimes Against Vulnerable Adults Advisory Task Force to review laws and submit recommendations by December 1, 2018, with membership including state agencies, Bar Association, judicial branch, county attorneys, and provider organizations.

• Repeals the Vulnerable Adult Maltreatment Review Panel statute and requires the Commissioner of Health to post substantiated maltreatment reports on the Office of Health Facility Complaints website.
