Defines "secondary school" as public or nonpublic schools, churches, religious organizations, or home schools where students fulfill compulsory instruction requirements.

Defines "independent contractor" as any person who contracts with, volunteers for, or is employed by a business that contracts with a secondary school.

Establishes criminal sexual conduct in the third degree for school employees or independent contractors who engage in sexual penetration with students aged 16-20 who have not graduated, with no consent or age mistake defense available.

Establishes criminal sexual conduct in the fourth degree for school employees or independent contractors who engage in sexual contact with students aged 16-20 who have not graduated, with no consent or age mistake defense available.

Effective August 1, 2018, and applies to crimes committed on or after that date.
