Commissioner of Education must assist districts and charter schools in developing and implementing consent education programs for grades 8-12 to prevent sexual assault.

Each consent program must include planning materials, in-service staff training, collaboration with local health services and organizations, and participation by student organizations.

Defines "consent" as affirmative, conscious, and voluntary agreement; clarifies that lack of protest does not equal consent, consent must be ongoing and can be revoked, and past dating or sexual relationships do not automatically indicate consent.

If a district fails to develop a program, the Department of Education must assist the regional service cooperative to develop or implement it.

Districts and charter schools may fund programs through public and private sources including public health funds, foundations, professional development funds, and federal or state grants; appropriation from general fund designated for fiscal year 2019.
