S.F. No. 3916 Summary

• Commissioner of Human Services shall establish implementation requirements and standards for electronic visit verification systems to comply with the 21st Century Cures Act (Public Law 114-255).

• Electronic visit verification must document service type, individual receiving service, date, location, service provider, and service start/end times for personal care assistance, community first services, home health services, and other covered home and community-based services.

• Commissioner must convene stakeholders including service providers and recipients to ensure requirements minimize administrative and financial burden on providers and service recipients while effectively preventing fraud and complying with state and federal law.

• Commissioner must make a state-selected electronic visit verification system available to providers, who may alternatively select their own system meeting commissioner-established requirements, with all systems required to provide data to the commissioner in specified formats and frequencies.

• Minnesota Statutes section 256B.0705 (prior mandated service verification requirements for personal care assistance services) is repealed effective upon enactment.
