• Requires the Pollution Control Agency commissioner to analyze and consider cumulative levels and effects of past and current environmental pollution from all sources when issuing permits to facilities in specific communities.

• Applies cumulative pollution analysis requirement to facilities located in first-class cities in Hennepin County that meet either of two sets of geographic and environmental conditions, including proximity to EPA superfund sites, low-income communities of color, disproportionate childhood health problems, air quality alert history, and heavy traffic corridors.

• Authorizes the commissioner to revoke or modify permits when necessary to prevent or abate pollution and maintains county authority over land use controls and solid waste facility siting regardless of state permit issuance.

• Permits facility construction, reconstruction, replacement, or modification to begin before commissioner issues a construction permit, except where prohibited by federal law.
