H.F. 1060 Summary

• Uniform traffic tickets must provide conspicuous notice of state-imposed surcharges under section 357.021, subdivision 6, and the current surcharge amount, effective August 1, 2019.

• Traffic ticket summons must include language informing defendants that all or part of costs may be waived upon showing of indigency or undue hardship, with instructions to contact the Minnesota Court Payment Center.

• Courts may reduce or waive criminal and traffic surcharges upon showing of indigency or undue hardship, and may authorize installment payments or permit community work service in lieu of surcharges.

• Before sentencing a person to pay fines, fees, or surcharges, courts must make a finding on the record regarding indigency or ability to pay without undue hardship, considering income, dependents, financial resources, living expenses, means-tested assistance receipt, and special circumstances.

• Minimum fine reductions (to not less than $50) and community work service options are available for defendants qualifying for public defender services or experiencing indigency or undue hardship.
