School boards may renew expiring referendums by board action instead of holding an election, provided the per-pupil amount remains the same or is adjusted for inflation in the same manner as the original referendum.

The renewed referendum term cannot exceed the initial term approved by voters.

School boards must adopt a written resolution authorizing renewal after holding a public meeting and allowing public testimony, with adoption required by June 15 each calendar year.

The renewal resolution becomes effective 60 days after adoption and must be submitted to the commissioner and county auditor by September 1 of the calendar year in which the levy is certified.

School boards may renew an expiring referendum no more than two fiscal years before it expires, with the referendum expiring in the last fiscal year it generates revenue for the district.
