Health plan companies must count payments made by enrollees to out-of-network providers toward the enrollee's annual deductible for covered health care services.

The requirement applies only to payments for health care services that would be covered under the enrollee's health plan if provided by an in-network provider.

Health plan companies are not required to pay for out-of-network services unless the enrollee's health plan terms require it, and coverage limitations for uncovered services remain unchanged.

The provision takes effect January 1, 2020, and applies to health plans issued or renewed on or after that date.
