Commissioner of Education must assist school districts and charter schools in developing and implementing a healthy and safe relationships curriculum for grades 6-12 designed to prevent and reduce sexual assault.

Required curriculum must include planning materials, in-service staff training, collaboration with community health services, student organization participation, and age-appropriate instruction on affirmative consent.

Affirmative consent instruction must cover that consent must be knowing, voluntary, active, and communicated through words or actions; silence or lack of protest does not constitute consent; consent can be withdrawn at any time; and persons unable to understand sexual situations due to incapacitation, drugs, alcohol, or sleep cannot consent.

Department of Education must provide funding for up to 12 hours of in-service training per year, and districts may supplement with funds from public and private sources including health funds, foundations, federal block grants, or other state and federal grants.

If a district fails to develop and implement the curriculum, the regional service cooperative must assist in developing or implementing the program.
