H.F. 2783 Summary

• Creates a new Department of Direct Care and Treatment effective July 1, 2020, headed by a commissioner appointed by the governor, responsible for developing and maintaining direct care and treatment services including secure treatment facilities, regional treatment centers, and community-based services.

• Creates a state Office of Inspector General effective July 1, 2020, headed by an inspector general appointed by the governor with senate confirmation for a six-year term, responsible for licensing and regulatory functions for health care facilities, child care, foster care, and human services programs.

• Transfers licensing and regulatory duties from the Department of Human Services and Department of Health to the new Office of Inspector General, including background studies, fraud detection, and overpayment recovery in human services programs.

• Amends Minnesota Statutes to designate the Department of Direct Care and Treatment as a state department and include both new agencies in salary and personnel provisions applicable to other state departments.

• Directs the revisor of statutes to prepare implementing legislation for the 2020 legislative session detailing statutory changes needed to complete the transfer of duties from existing agencies to the new departments.
