HF 300 Summary

• Grants original jurisdiction to district courts over actions seeking legal, equitable, or declaratory relief arising from alleged violations of public procurement laws, requirements, procedures, or public contract awards

• Applies jurisdiction regardless of whether a public entity involved acted in a judicial or quasi-judicial capacity

• Requires procurement process participants to file actions prior to full contract execution unless they diligently sought necessary information and were denied reasonable access to information or opportunity to seek court relief before execution

• Specifies that receipt of data under Minnesota Statutes section 13.591, subdivisions 3 or 4, at least 15 days prior to contract execution constitutes reasonable access and opportunity to seek relief

• Exempts fraud, misrepresentation, and acts following contract execution from the pre-execution filing requirement and does not alter standards of review, available remedies, or damage award prohibitions under existing law
