School districts must allow charter school and nonpublic school students to participate in extracurricular activities on the same basis as public school students, provided their enrolling school enters into a cooperative arrangement with the resident district.

Home school students receiving instruction as defined in statute are also eligible to fully participate in extracurricular activities on the same basis as public school students.

Extracurricular activities are defined as activities not offered for school credit or required for graduation, generally conducted outside school hours, with content determined primarily by student participants under staff guidance.

School districts may charge charter schools or nonpublic schools for any additional costs directly related to student participation in extracurricular activities, including the cost of additional staff.

The provision becomes effective July 1, 2020.
