• Prohibits any person from offering, selling, giving, or furnishing flavored tobacco, tobacco-related devices, electronic delivery devices, or nicotine/lobelia delivery products to any person.

• Increases administrative penalties for licensees selling prohibited products: first violation $300 (up from $75), second violation $600 (up from $200), third violation $1,000 (up from $250) with mandatory 7-day suspension and possible revocation.

• Persons age 21 or older who furnish flavored products face misdemeanor charges for first violation and gross misdemeanor for second or subsequent violations within five years.

• Persons under age 21 who furnish flavored products are subject only to alternative civil penalties such as education programs, community service, or court diversion programs, with no fines or monetary penalties allowed.

• Defines "flavored product" as any tobacco product imparting a taste or smell other than tobacco, including menthol, mint, fruit, chocolate, candy, dessert, or alcoholic beverage flavors; effective August 1, 2020.
