Requires the commissioner of corrections to ensure all state correctional facilities and inspected facilities have policies and programs that preserve and protect inmate constitutional rights and provide adequate health and wellness care.

Mandates sheriffs apply the same rules to all inmates under their care regardless of the grounds for detention or government authority that ordered the detention.

Allows counties with existing contracts that do not comply with equal treatment standards to honor those contracts, but prohibits renewing or entering new contracts that violate the equal treatment requirement.

Sections become effective May 1, 2021.
