Establishes a moratorium prohibiting the state, local governments, county sheriffs, and their agencies from entering into agreements for detention in privately owned, managed, or operated correctional facilities.

Prohibits payment, reimbursement, subsidies, or cost deferrals related to the sale, purchase, construction, development, ownership, management, or operation of private correctional facilities.

Prohibits receiving per diem payments, per detainee payments, or any other payments related to detention in privately operated facilities.

Permits state and local governments to contract with private entities for ancillary services in publicly operated facilities, including medical services, food services, educational services, and facility maintenance.

Declares that correctional facility management involves inherently governmental functions requiring coercive police powers that should not be delegated to the private sector due to liability, accountability, and cost concerns.
