H.F. No. 3180 Summary

• Prohibits manufacturing, selling, offering for sale, distributing, or using food packages in Minnesota that contain intentionally added PFAS (perfluoroalkyl and polyfluoroalkyl substances).

• Defines "food package" as packaging intended to market, protect, or handle products for food or beverage contact, including containers, trays, bags, wrappers, closures, coatings, inks, and labels.

• PFAS is defined as a class of fluorinated organic chemicals containing at least one fully fluorinated carbon atom.

• Grants the Pollution Control Agency commissioner enforcement authority under Minnesota Statutes sections 115.071 and 116.072, with coordination required from the commissioners of commerce and health.

• Effective date is January 1, 2021.
