Pharmacy benefit managers and health carriers cannot require or prefer any specific pharmacy or provider for prescribing or dispensing reference biological products, biosimilar products, or interchangeable biological products.

If a pharmacy benefit manager or health carrier covers any one of these three product types, it must provide equivalent coverage for all three types.

Prohibits requiring patients to switch from a prescribed product to another product with a higher retail price.

Exempts public health care programs under chapters 256B and 256L, and the State Employee Group Insurance Plan (SEGIP) under chapter 43A from these requirements.

Requires the commissioner of health to analyze the effect of this law on net prices for different payors and report findings by December 15, 2022; all provisions effective January 1, 2021.
