Food and beverage service establishments must not provide or sell single-use plastic straws to customers unless specifically requested.

Plastic straws include disposable tubes made from petroleum-derived plastic or biologically-based polymers (such as corn or plant sources).

Establishments receive no penalty for the initial violation but face a $50 civil penalty for each subsequent violation, capped at a maximum of $500.

The attorney general may bring enforcement actions for recovery of civil penalties or injunctive relief, and may accept assurances of discontinuance from violating establishments.

The law becomes effective September 1, 2020.
