Amends Minnesota Statutes section 307.08 to replace "human burial grounds" language with "cemetery" throughout the statute governing protection of burial sites.

Changes the role of the state archaeologist from "authenticating" burial grounds to "assessing" cemeteries and maintaining records of known, recorded, or suspected cemetery locations.

Requires the state archaeologist and Indian Affairs Council to respond within 90 days to requests for cemetery condition assessments and provide notice whether an assessment is needed.

Establishes separate procedures for assessing American Indian cemeteries (Indian Affairs Council discretion) versus non-American Indian cemeteries (state archaeologist discretion), with collaborative assessment for mixed or undetermined ancestry remains.

Maintains felony and gross misdemeanor penalties for intentionally destroying, mutilating, disturbing, or removing human remains, tombstones, or cemetery structures without appropriate authority consent.
