Commissioner of health shall design a wholesale prescription drug importation program complying with federal law (21 U.S.C. § 384) in consultation with commissioners of human services and commerce, stakeholders, and federal officials.

State agency must become a licensed drug wholesaler or contract with one to import safe prescription drugs from Canadian suppliers regulated under Canadian law, meeting FDA safety and effectiveness standards.

Program shall import only drugs expected to generate substantial savings for Minnesota consumers and prohibit distribution, dispensing, or sale of imported drugs outside Minnesota.

Commissioner must comply with federal drug tracking and tracing requirements and develop audit functions, financial sustainability recommendations, and provisions to monitor for anticompetitive behavior.

Commissioner shall submit program design and recommendations to legislative health care and finance committees by January 1, 2021, and request federal certification from the Department of Health and Human Services upon legislation adoption.
