H.F. 3988 Summary

• Extends health insurance coverage to former Department of Corrections and Department of Human Services employees who were assaulted while employed and became totally and permanently disabled as a direct result of that assault.

• Includes coverage for employees who qualify for duty disability (physical or psychological) under the correctional employee retirement plan, or who discontinued employment due to disabling injury and meet duty disability criteria.

• Requires the Department of Corrections or Department of Human Services to continue providing medical and dental benefits through the State Employee Group Insurance Program using existing budget resources until the person reaches age 65.

• Employer contributions must equal the amount provided to active state employees at the time of payment, with employee responsible for making required employee contributions; dependent coverage continues under the same terms.

• Establishes a determination process through the Minnesota State Retirement System executive director with appeal rights to the Office of Administrative Hearings, with review limited to writ of certiorari to the Minnesota Court of Appeals.
