HF 4028 Summary

• Modifies Hennepin County's set-aside contracting program to allow construction service businesses to meet employment requirements by committing to employ at least 20 percent of total labor hours from persons eligible for public assistance or rehabilitation services, in addition to the existing 50 percent employee requirement.

• Authorizes Hennepin County to use construction manager at risk (CMAR) method for projects estimated to exceed $20,000,000, with competitive selection based on qualifications and guaranteed maximum price contracts.

• Establishes CMAR selection process requiring a county selection committee with minimum three members (at least one with construction expertise) to evaluate proposers' experience, capacity, technical competence, past performance, safety record, and compliance with state and federal law.

• Requires construction managers at risk to competitively bid all trade contract work from qualified firms, with ability to limit bidding to Small Business Enterprise and/or Disadvantaged Business Enterprise (SBE/DBE) firms subject to availability.

• Repeals Minnesota Statutes section 383B.143, subdivisions 2 and 3, which previously limited agreement durations for installment purchases and other county contracts to seven years.
