Defines "public health emergency" as a determination by the commissioner of health regarding pandemic influenza or communicable/infectious disease outbreaks meeting one of four criteria: requiring evacuation or relocation to temporary facilities, posing probability of large-scale deaths or serious injuries, involving widespread exposure to infectious agents, or posing significant risk of harm or high morbidity/mortality rates.

Authorizes the governor to declare a peacetime emergency when a public health emergency endangers life and property and local resources are inadequate, with mandatory notification to legislative leaders.

Limits peacetime emergencies to five days unless extended by Executive Council resolution up to 30 days, but allows public health emergencies to be continued for up to 90 days.

Permits the legislature to terminate any peacetime emergency extending beyond 30 days by majority vote of each house, and requires the governor to convene the legislature immediately if extending beyond 30 days while legislature is not in session.

Becomes effective the day following final enactment.
