• Establishes a rate floor of $115 per day for 24-hour customized living services provided at designated disproportionate share facilities, notwithstanding other rate limits under Minnesota Statutes chapter 256S.

• Designates three specific assisted living facilities as eligible for disproportionate share status: facilities in Brooklyn Center (Hennepin County, 158 units), West St. Paul (Dakota County, 164 units), and St. Cloud (Sherburne County, 137 units).

• Requires facilities to have at least 80 percent elderly waiver participants on May 1 of the application year to qualify for disproportionate share designation, with applications submitted annually between June 1 and June 15.

• Mandates the commissioner adjust the rate floor at least annually and revise the customized living tool to incorporate these rate adjustments, with the rate floor value excluded from elderly waiver clients' monthly case mix budget caps.

• Effective July 1, 2020, or upon federal approval, whichever is later, and applies to services provided on or after that date.
