HF4358 Summary

• Adds persons civilly committed as sexually dangerous persons or with sexual psychopathic personality to the list of ineligible firearm possessors in Minnesota Statutes section 624.713, subdivision 1, clause (14).

• Prohibits civilly committed sex offenders from possessing any firearm or ammunition unless ability to possess is restored through court petition.

• Allows such persons to petition a court for restoration of firearm possession rights if circumstances show they are not likely to act dangerously and granting relief would not be contrary to public interest.

• Court may consider evidence from licensed medical doctor or clinical psychologist showing the person no longer suffers from the condition or has been successfully treated for three consecutive years when evaluating restoration petitions.

• Specifies that judicial determination includes court proceedings under sections 253B.07-253B.09, chapter 253D, or comparable laws from other states.
