HF 4381 Summary

• Eliminates the requirement that utilities pay renewable energy qualifying facilities a rate based on the utility's least cost renewable energy facility or competing supplier bid, whichever is lower.

• Removes the provision allowing the Minnesota Public Utilities Commission to deny renewable resource use if it determines such use is not in the public interest.

• Utilities must still purchase all energy and capacity from qualifying facilities at full avoided capacity and energy costs, but these costs are now determined through negotiation, commission order, or competitive bidding without the renewable energy pricing formula.

• Adds requirement that the commission shall set rates for electricity generated by renewable energy.
