HF 4450 Summary

• Requires Minnesota State Colleges and Universities and eligible private postsecondary institutions to adopt comprehensive sexual harassment and sexual assault policies with specific victim protections and reporting procedures.

• Mandates impartial investigations, timely resolution of complaints, and adequate due process protections for accused students including equal access to evidence, advisors/attorneys, and witness testimony without personal cross-examination.

• Requires institutions to apply preponderance of the evidence standard in disciplinary proceedings and prohibit conditioning financial aid or remedial actions on survivors signing nondisclosure agreements.

• Establishes mandatory training requirements for campus security and administrators on sexual assault prevention and victim-centered practices, plus student sexual assault prevention training within 10 business days of enrollment.

• Requires annual data collection and public reporting of sexual assault incidents, investigations, disciplinary outcomes, and memorandums of understanding with local law enforcement; effective August 1, 2021.
