Home care providers must submit any evidence or documentation they hold regarding conduct of current or former staff members when reporting to health-related licensing boards if the conduct may constitute grounds for disciplinary action.

Home care providers must promptly notify all clients who received services from a dismissed or terminated staff member within the previous three months, and recommend that clients contact the provider if the staff member seeks to continue providing services.

Home care providers licensed under chapter 144A are now included in reporting requirements to the Board of Nursing when disciplinary actions are taken against nurses, with reports required to specify the grounds for disciplinary action.

Health-related licensing boards may conduct site visits to inspect records pertaining to complaints, and institutions, organizations, or providers must provide the executive director or designated board member with access to all applicable records during such visits.
